Client care

My aim is clear advice, realistic timescales and no surprises on fees. I will keep you informed of progress, tell you promptly of anything that materially affects your proposal or the fee, and respond to you promptly. I take your privacy seriously and this policy sets out how information is collected and handled, and why; how I might disclose that information and keep it secure.

Privacy notice (how your personal information is handled)

1. Who I am

CS Planning is a chartered planning consultancy based in Devon, providing planning advice to homeowners, individuals and developers. CS Planning is registered with the ICO, registration number ZC231472 .

The data controller for the personal data held and processed about you is Cheryl Stansbury. Personal data is held in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

2. Personal information collected

Most of the personal information collected will be provided directly by you.

The following information may be collected and processed: your name, contact details, address, information about the property/site and your interest in it, correspondence, financial information for invoicing and payment, personal or financial data within the documents you give me or I prepare in relation to planning matters and correspondence such as emails, notes of meetings/telephone conversations or letters.

Unless required for a specific purpose for example, as justification for a planning application and only then with your consent, special category information such as medical details is not collected.

3. Why the personal information is collected, and the lawful basis

Personal information is collected for one of the following purposes:

  • Contract: To provide planning services and perform my contract with you; to submit and manage applications/appeals with the local planning authority and others

  • Financial requirements and obligations: Billing, accounts and recovering fees; meeting tax and regulatory duties

  • Consent: Running and improving my business, records and marketing purposes where you have given consent

  • Legal obligation: To comply with statutory or regulatory requirements

  • Legitimate interests: To operate and improve my services; keeping proper records, managing risk and recovering debts; promoting my services to existing clients

4. Information sharing

Personal data may be shared, so far as needed for the matter, with: local planning authorities and their officers; statutory and non-statutory consultees (e.g. highways, drainage, heritage, environmental bodies); sub-consultants and specialists I or you appoint (e.g. architects, ecologists, lawyers, heritage or transport consultants); my professional advisers, insurers and auditors; and HMRC and other authorities where required by law.

Note that a planning application and its documents become public once submitted and each local planning authority has its own data retention and handling policies.

Your personal data will never be sold to any third party, or transferred to any third party unless with your permission or required to do so by law.

6. How long information is retained

Your file and personal data will be retained digitally for a minimum of 6 years after the matter ends to meet my professional/insurance requirements, after which it will be securely deleted/destroyed, unless a longer period is required by law.

7. Your rights

You have the right to:

  • Access your data

  • Have inaccurate data corrected or erased

  • To restrict or object to processing

  • Data portability, to ask the information is transferred to another organisation

  • To lodge a complaint with the ICO; further details are available at https://www.ico.org.uk

Where I rely on consent, you can withdraw it at any time. To exercise any right, contact me at cheryl@csplanning.uk. Some rights are qualified and may not apply to every situation.

8. Security

I take appropriate measures to protect your personal information from unauthorised access, alteration, disclosure, or destruction.

9. Changes to this privacy notice

This privacy policy may change from time to time in line with legislative changes. You will not be explicitly informed of any changes and it is recommended you check this page periodically.
